Klara Castanho was the victim of multiple rights violations

After being threatened by a nurse and having intimate information exposed in the press, the 21-year-old actress, Klara Castanho, made public her report about the delivery of a child resulting from rape and the consequent coercion suffered during the process. See how institutions and those involved reacted to the statement.

Cofen (Federal Nursing Council) and Coren-SP (São Paulo Regional Nursing Council) stated this Sunday (26) that they will investigate the conduct of the medical team involved in Klara Castanho's case.

The actress became pregnant after being a victim of rape and gave the child directly for adoption – a legally supported decision. After seeing her name involved in the case through statements by columnist Leo Dias and youtuber Antonia Fontenelle, Klara went public through open letter (25 / 06).

In the publication, she reports having been approached by a nurse who threatened to leak her story to a columnist if she maintained her decision – provided for in Brazilian legislation – to place the child for adoption. According to Klara, this happened postpartum, when she was still under the influence of anesthesia.

She also reports having been forced by a doctor at the same hospital to listen to the baby's heart. Hospital e Maternidade Brasil, which is part of Rede D'Or, announced on Sunday (26) that it “sympathizes with the patient and family and informs that it has opened an internal investigation to investigate this fact”.

“Giving birth to a child and not wanting to see it, and having it dumped at random is a crime, yes. It's abandonment of the incapable. Even more so when you have a good financial situation”, said presenter and YouTuber Antonia Fontenelle, in one of the series of publications she made giving her opinion on the story – without mentioning names. The post was deleted after negative repercussions.

On June 23, in a live broadcast on her channel “Na Lata com Antonia Fontenelle”, after commenting on the case of the 11-year-old child who had a legal abortion denied in SC, the presenter showed Leo Dias' interview with Gentilli and added that it was a “21-year-old TV Globo actress who hid her pregnancy”.

On the 26th, in an interview with Sergio Malandro and Renato Rabelo's podcast, Fontenelle also stated that the actress said she had “been abused”. Next, podcast participant Renato Rabelo questiona: “But she didn’t even give it to her father? Does she even know who her father is? That’s a bomb.”

In May this year, Fontenelle launched a pre-candidacy for federal deputy in Rio de Janeiro for the Republican party, the same as the former Minister of Women in the Bolsonaro government, Damares Alves.

After reaffirming his comments about the case, Fontenelle changed his tone in the face of pressure. “What reached me was not what you wrote in your open letter. When I did the live, I didn't mention his name and what came to me was that a black child was handed over to a shelter and I know very well what a black child goes through in a shelter waiting for adoption”, he said. “It’s not internet chatter, it’s not sealing. I want to do everything possible and impossible to put this rapist in jail. Let me help you. Your report that you suffered violence came to me now. Let me get to whoever did this to you and I have the means.”

What is in the law

The woman's decision to hand over the child when she does not want to or cannot, “before or shortly after birth”, is protected by law and is provided for in the Child and Adolescent Statute. It is also the right of the biological mother and child to remain confidential in the process. Therefore, data leaks can lead to punishment for those responsible.

💡To proceed with the legal delivery of the child, the woman must contact the Children's Court or the Public Prosecutor's Office.
