Law that reduces the minimum age for tubal ligation comes into force in 180 days

The text, approved by the National Congress and sanctioned by the Presidency of the Republic, changes the 1996 law on family planning and lowers the minimum age to carry out the procedure. Furthermore, the new text does away with the requirement for authorization from the partner for sterilization to take place.

The new law lowers the minimum age for tubal ligation (female sterilization) and also for vasectomy (a procedure performed on men) from 25 to 21 years.

The new text changes the Family Planning Law, which is in force, excluding the need for the consent of the spouse or partner for the surgery to be performed. The changes also make it easier for young women to undergo tubal ligation after giving birth.

The sanction was celebrated on social media by women's groups and politicians who work in the area, considered an advance in women's rights. There was also criticism of the delay in updating the law.

The new text on tubal ligation was sanctioned without any presidential veto, and comes at a time when President Jair Bolsonaro, candidate for re-election by the PL, tries to lead the female electorate to rise in the polls of voting intentions, including the first lady in the electoral propaganda.  (UOL)

A Minimum age for carrying out the procedure is not required for those who already have at least two living children. The period between expressing the will and carrying out the procedure continues to be 60 days.

Current legislation prohibits tubal ligation during childbirth, abortion or up to the 42nd day postpartum or abortion, except in cases of proven need.

The new text was published in Official Gazette this Monday (5) will come into force 180 days after publication.
