What is 'slut-shaming'? Luana Piovani brings the topic to light after nude photos in process

In recent days, the networks have been buzzing with the most recent fight between Luana Piovani and her ex-husband, surfer Pedro Scooby. The actress and presenter, who currently lives in Portugal, went public to say that Scooby - with whom she has three children - sued her in Portuguese justice. In the middle of the report, Luana revealed that she found intimate images of her among the documents attached to the lawsuit. During the video, Luana says that her lawyer warned her that the photos serve as a way of “disqualifying her as a woman", to harm her in the process. The practice is known and has a name: 'slut-shaming'. Have you ever heard about it?

What does this mean 'slut-shaming'?

In literal translation, means something like “slut shaming” or “promiscuous”.

It consists of embarrassing a woman by classifying her as a 'slut', an action that seeks to humiliate women for their sexuality, sexual practices or behavior, whether in the use of their clothes, the way they speak or act, in a type of moral censorship.

Men and women can practice 'slut-shaming', but the act is most often aimed at women as it is a quest to control female sexuality.

What does Brazilian legislation say?

O Curto News talked to Adriana Spengler – lawyer, national vice-president of the Brazilian Association of Criminal Lawyers (ABRACRIM) and law professor – on the subject.

Second Adriana, or 'slut-shaming' occurs frequently in Brazil, but came to light because it concerns a famous person.

“Sexually and morally disqualifying a woman is unfortunately still a remnant of the patriarchal and in many aspects still misogynistic society in which we live.”

The expert states that the attitude can have serious consequences that undermine the woman's honor (crime of insult – article 140 of the Brazilian Penal Code), which may cause psychological harm (crime of psychological violence – art.148-B of the Brazilian Penal Code).

She also recalls that, in 2021, Law 14.425, known as Mari Ferrer Law. The legislation prohibits the practice of acts that undermine the dignity of the victim and witnesses and prohibits the use of language, information or material that offends the victim during the trial – the penalty is increased if it involves a crime against sexual dignity.

Displaying and/or sharing intimate images without the consent of the person depicted is also a violation of privacy that may result in legal action.

Adriana points out that, apart from criminal issues, in the case under analysis the moral damage is indisputable, especially if we can imagine that a court could take into account this “evidence” (in this case, the intimate photos of Luana Piovani).
