First day after elections that gave Lula victory begins tensely

The morning of the first day after the election that gave victory to Luiz Inácio Lula da Silva began tensely. A demonstration of truck drivers took over several roads in the country and, despite having been officially informed of his opponent's victory shortly after the end of the count by the president of the TSE, Minister Alexandre de Moraes, President Jair Bolsonaro had not yet spoken out. until 10 am today (31).

Minister Alexandre de Moraes personally called on Sunday night (30) the elected President of the Republic, Luiz Inácio Lula da Silva (PT), and the runner-up, the current head of the Executive, Jair Messias Bolsonaro (PL), to congratulate you on your participation in the democratic process. In the phone call, he informed that the Electoral Court was able to declare the official result of the 2022 General Elections.

“I congratulated them both for having participated in the most important moment of democracy, which is the elections”, he said.

Alexandre de Moraes denied that there was a real risk of contesting the result of the election. “The result has been proclaimed, accepted and those who were elected will graduate in December and take office on January 1st”, he stated. As for possible fissures, the minister stated that it was part of the political and democratic game. “Now it is much more up to the winners to unite the country, because those who were elected will govern for everyone and not just for their voters. If there are challenges within the electoral rules, they will be analyzed normally. This is part of the rule of law.”

Federal Highway Police

The president of the TSE said that the Electoral Court will investigate whether the operations carried out by the Federal Highway Police (PRF) this Sunday interfered with the progress of the elections. He ruled out, however, that there was any influence on the result and voter participation in the election. “In the Northeast region, where it was considered that the operation would have been disruptive, abstention decreased. In other regions where there was no operation, abstention increased. So, no causal link was shown,” he said.

According to Alexandre de Moraes, the written response from the director general of the Federal Highway Police will be added to the case file. “If misuse of purpose or abuse of power is proven, he will respond. Not only him, but those who carried out the orders will be held civilly and criminally liable,” he concluded.

Objections

Alexandre de Moraes stated that the objection processes against the campaigns of candidates Luiz Inácio Lula da Silva and Jair Bolsonaro are still in the investigation phase and will be handled normally within legal procedures. “The evidence will be produced and, finally, the TSE Plenary will judge”, he explained. “Democracy is also embodied in the Rule of Law. In other words, democratic rules also respect the rules of the Rule of Law. If there was ineligibility, they will be judged. If not, they will be rejected. We will judge and analyze normally”, added the minister.

Transparency

Alexandre de Moraes also cited the TSE's actions to ensure even more transparency in the Brazilian electoral process, such as the invitation to the participation of international observers, who, alongside the Public Electoral Ministry and the Brazilian Bar Association (OAB), were able to monitor the entire the election and demonstrate the reliability of the elections.

“Elections with more extended scores and elections with less extended scores are part of the democratic game. What the TSE can guarantee Brazilian society is that elections are clean, safe and transparent. And this is very important for any pacification. Those who won know that they won fairly and those who didn't win know that they didn't win because there were no votes. And that’s part of the democratic game,” he said.

Armed forces

According to Alexandre de Moraes, the Armed Forces acted as the other monitoring entities for the 2022 Elections, within the regulations provided for by the TSE.
