Minimum wage: a worker’s right

What is the salary minimum? It is the minimum amount, provided by law, that the employer can pay to a worker. It is defined by the government, which must follow the Constitution and preserve purchasing power and basic needs for the survival of citizens and their families.

O minimum wage emerged in 1936, during the administration of then president Getúlio Vargas, but was established only 4 years later. Since then, it has undergone numerous readjustments, as foreseen in the original idea, following the fluctuation in prices of essential items and services. 

It is a right provided for in federal Constitution, in its article 7, section IV, according to which: “The rights of urban and rural workers, in addition to others aimed at improving their social condition, are: minimum wage, fixed by law, nationally unified, capable of meeting your basic vital needs and those of your family with housing, food, education, health, leisure, clothing, hygiene, transportation and social security, with periodic readjustments that preserve your purchasing power, and its connection for any purpose is prohibited".

The logic behind the creation of the minimum wage policy is to guarantee the basic livelihood of workers and their families. It affects the lives of all Brazilians – after all, it is the base value of remuneration for employees, retirees, pensioners… Everyone who has or had their contract signed one day and worked under the CLT regime has their remuneration affected by changes in salary.

But how is the minimum wage calculated?

The national minimum wage corresponds to a unified national value determined by law for all types of workers. However, some states have their own salaries due to the higher cost of living or according to government strategies to boost specific sectors.

In 2022, they are: São Paulo, Rio de Janeiro, Paraná, Santa Catarina and Rio Grande do Sulsystem. (G1)

What is the current minimum wage?

In Brazil, the value of the current minimum wage, defined by the federal government for 2022, is R$ 1.212,00 (one thousand, two hundred and twelve reais). It was fixed in Provisional Measure 1.091 / 2021.

The same measure also establishes that the daily value of the minimum wage corresponds to R$40,40 (forty reais and forty cents), and the hourly value, to R$5,51 (five reais and fifty-one cents). (The Senate Agency)
