STF forms majority and suspends nursing salary floor

This Thursday (15) the Federal Supreme Court (STF) formed a majority to suspend the nursing salary floor until new calculations are made on the ways to finance the new law. The voting score was 6 against and 3 in favor.

When the law that creates the new minimum for nursing was blocked, the case's rapporteur at the Supreme Court, Minister Roberto Barroso, just wanted to understand and guarantee where the resources will come from to honor these increases. This is not about going against salary increases for the category, but rather about financial responsibility. That is, who is going to pay this bill?

In this Thursday's session (15), the entire Supreme Court panel was summoned to decide on the issue. Ministers voted against or in favor of Barroso's report.

Ricardo Lewandowski, Alexandre de Moraes, Dias Toffoli, Carmen Lúcia and Gilmar Mendes accompanied the rapporteur and voted to suspend the minimum remuneration of R$4.750 per month.

Barroso gave two months for Congress and the Executive to explain the financial changes and ways they can pay for the measure's expenses.

Understand why the nursing floor ended up in the Supreme Court

The minimum minimum wage of R$4.750 for nurses was created based on a law approved by the National Congress, determining that nursing technicians receive 70% of the amount and nursing assistants and midwives receive 50%.

After the sanction of President Jair Bolsonaro – who is campaigning for re-election – states, municipalities and private hospitals began to argue that the amounts could cause a hole in public accounts. The National Confederation of Health, Hospitals and Establishments and Services went to the STF, which understood that the allegations were valid.
