Italian court asks Robinho to serve his prison sentence in Brazil for rape

The Italian court has asked the Brazilian government that former football player Robinho pay in Brazil the nine-year prison sentence he was sentenced to for the gang rape of a young girl in Milan in 2013, the Brazilian Ministry of Foreign Affairs said this Friday ( 17).

The request was forwarded for analysis to the Department of Asset Repatriation and International Legal Cooperation of the Ministry of Justice and Public Security. This body analyzes processes of this type due to the fact that the Brazilian Constitution does not allow the extradition of its citizens and Robinho is in the country.

However, it is up to the Brazilian courts, before the government proceeds, to formally evaluate the request and eventually approve the execution of the foreign sentence, a process provided for in the Magna Carta and which could last several years, according to judicial experts.

The request is the latest effort by the Italian authorities to ensure that the 39-year-old former national team player serves the sentence he was sentenced to. At the beginning of last year, the Milan Public Prosecutor's Office requested his extradition – denied by Brazil – and issued an international arrest warrant against him. This latest request prevents the former athlete from traveling to countries with which Italy has extradition agreements.

Robinho was sentenced by Italy's last judicial instance on January 19, 2022 for sexual violence in a group against a young Albanian woman who was celebrating her 23rd birthday in a well-known nightclub in Milan. The then Milan player, together with five other compatriots, made the young woman drink “to the point of leaving her unconscious and unable to resist” and then had “ sexual intercourse several times in a row” with her.

The former Brazilian striker was convicted in 2017 in the first instance by the Milan Court and in December 2020 by the Milan Court of Appeal. His friend Ricardo Falco was also found guilty of the act.

The latter court considered that Robinho he acted with “particular contempt for the victim, who was brutally humiliated”.
