ChatGPT is blocked in Italy due to non-compliance with personal data legislation

The Italian authorities announced this Friday (31) the temporary blockade of the ChatGPT, accused of not respecting legislation on personal data and of not having a verification system for underage users. A OpenAI has 20 days to adopt measures to protect minors under penalty of a fine and increased lockdown. O ChatGPT arrived in Italy in November 2022 and was quickly adopted by users impressed by its ability to clearly answer difficult questions, write sonnets and even pass tests and exams.

This decision, “with immediate effect”, will have the consequence of “the provisional limitation of the processing of Italian users’ data in relation to the OpenAI”, creator of ChatGPT, informed the Italian national authority for the protection of personal data in a statement.

The Italian authority also highlights that the ChatGPT “suffered, on March 20, a loss of data ('data Breach') regarding user conversations and information relating to payment by subscription service customers”.

The watchdog also criticizes the ChatGPT due to the “lack of an informative note for users, whose data is collected by OpenAI, but, above all, due to the absence of a legal basis that justifies the mass collection and conservation of personal data, with the aim of 'training' the algorithms that make the platform work”.

Protection for data of children under 13

Although Artificial Intelligence is aimed at people over 13 years of age, “the absence of any filter to check the age of users exposes minors to responses that are not at all in line with their level of development”, highlights the data authority from Italy.

The entity asks the OpenAI which “communicate, within 20 days, the measures adopted” to remedy this situation, “under penalty of a fine of up to 20 million euros (US$21,75 million), or up to 4% of annual global turnover”.

This announcement comes after the European police agency (Europol) warned, on Monday, that criminals were willing to take advantage of Artificial Intelligence, such as ChatGPT, to commit fraud and other cybercrimes.
