Getty Images sues artificial intelligence platforms alleging copyright infringement

In January 2023 alone, three artists and the photographic agency Getty sued platforms that develop artificial intelligence tools alleging breach of copyright.

The AIs involved are stable diffusion, Midjourney e DevianArt. They all work in the artistic field, delivering images based on textual commands. From this, the authors and Getty allege that the platforms used their texts and images to teach their programs.

For lawyers involved in the procedures, laws in the United States and Europe may be favoring artificial intelligence platforms. 

Platforms may be benefiting

On the European continent, a 2019 standard began to authorize the right to deep exploration, known as “data mining”, even in content protected by copyright. This is as long as the content is accessible to the public. However, there is an exception for cases where the rights holder does not authorize such use.

For Pierre Pérot, from the Parisian studio August Debouzy, it will be difficult to know whether a work was used during the learning phase. The intellectual property advisor also states that “the AIs explain in their general conditions that the user is the one who will be responsible for the use they will make of the content…There is nothing to prevent its commercialization”.
