Another fine for Meta: company fails to comply with WhatsApp data protection

This Thursday (19), Meta, owner of Facebook, was fined 5,5 million euros for failing to comply with European Union data protection regulations with its WhatsApp messaging application.

In the decision, the Irish data protection commission, which acts on behalf of the EU because the group's European headquarters is in Ireland, considered that the digital giant operated “failing to comply with its transparency obligations”, informed the regulatory body in a note.

Furthermore, Meta was based on a mistaken legal basis “for your processing of personal data for the purpose of improving and securing the service”, he added, giving the group a period of six months to “adjust your data processing operations” in accordance with European regulation.

The sanction is based on similar reasons to the one adopted on January 4 against the Meta, which was fined 390 million euros in relation to its social networks Facebook and Instagram.

The American group immediately announced that it intends to file an appeal.

In September 2021, the Irish regulatory body had already imposed a €255 million sanction on WhatsApp for failing to comply with its transparency obligations, in particular with regard to data transfers to other group companies.

The DPC also fined Meta 405 million euros in September for failures in the handling of minors' data and 265 million euros in November for not sufficiently protecting its users' data.

The new round of sanctions in January is a consequence of the adoption of three binding decisions by the European data protection committee in early December.
