Airbus and Air France are acquitted for Rio-Paris flight accident in 2009

The French court acquitted this Monday (17) the European manufacturer Airbus and the company Air France for the crash of flight AF447 Rio-Paris in 2009, which killed 228 people, for which the companies were tried for intentional homicides. Almost 14 years after the tragedy, the court considered that, although the companies had committed "failures", it was not possible to demonstrate "any safe causal relationship" with the accident.

On June 1, 2009, flight AF447, which was traveling between Rio de Janeiro and Paris, crashed in the middle of the night in the Atlantic Ocean, a few hours after takeoff. The 216 passengers and 12 crew on board died in the tragedy.

This was the deadliest accident in the history of French commercial aviation.

On board the plane, an A330 with registration F-GZCP, were people of 33 nationalities: 61 French, 58 Brazilians and 28 Germans, as well as Italians (9), Spanish (2) and one Argentine, among others.

Investigation and prosecution

After a long process, marked by conflicting opinions from the judges and which took place from October 10th to December 8th, the Public Ministry had requested the acquittal of the two companies, considering that it was “impossible to demonstrate” their guilt.

The request was not accepted by the civil parties, as they considered that it “points exclusively against the pilotand in favor of two multinationals”, criticized Danièle Lamy, president of the association 'Entraide et Solidarité AF447' (Cooperation and Solidarity AF447), which represents the victims' relatives.

Throughout the trial, representatives of Airbus and Air France claimed that the companies did not commit any crime. The lawyers asked for acquittal, a “humanly difficult decision, but technically and legally justified”, according to Airbus management.
