Art created by AI is not protected by copyright, US judge rules

Judge Beryl Howell ruled, last Friday (18), that arts created by artificial intelligence are not protected by copyright law because they do not have human authorship. The resolution was presented by the judge after a lawsuit against the United States Copyright Office.

The author of the case is Stephen Thaler, who requested copyright for an image generated by AI (the one shown at the opening of this text). He claimed that his machine generated a work of art on its own, for which he wanted the copyright, listing the computer system as the author. The request was denied, and the judge highlighted that “human authorship is a fundamental requirement”.
